The Conflict of Interest and Ethics Commissioner and I have agreed that a conflict of interest screen is an appropriate compliance measure for me, aimed at preventing any opportunity to further the private interests of my friend, Ms. Gail Hamamoto, in Special Olympics Canada or its subsidiaries, affiliates and associates, or to give preferential treatment to Special Olympics Canada, while I exercise my official powers, duties and functions as a reporting public office holder.
Accordingly, I have agreed to abstain from any discussion or decision in relation to Special Olympics Canada or its subsidiaries, affiliates, and associates. I also agree not to have any communication with government officials in relation to any matter or decision-making processes affecting my friend's interests.
This screen is administered by the Deputy Minister and my Chief of Staff to ensure that I am neither made aware of nor participate in any official matters or decision-making processes involving my friend's private interests, unless the interest in the decision or matter is of general application. Moreover, all authorities for decisions on matters that form part of this screen will be exercised by the Minister of Canadian Heritage.
The Prime Minister of Canada, the Clerk of the Privy Council and Secretary to Cabinet, the Parliamentary Secretary, the members of my ministerial staff, as well as necessary public servants have been informed in writing about this conflict of interest screen.
I have undertaken to inform the Conflict of Interest and Ethics Commissioner at the earliest opportunity of all changes of which I become aware that relate to or should form part of the above list of matters caught by this screen.
In the event that I am made aware of a matter that forms part of this screen or any such matter comes before me, I am required under section 21 of the Act to recuse myself from that matter. - On June 14, 2019, in the exercise of my official duties, I recused myself from the discussions and decision concerning the nomination process of a new Chief Accessibility Officer in order to avoid any appearance of preferential treatment or any opportunity to further the private interest of my friend, Ms. Stephanie Cadieux.
- Pursuant to the Public Servants Disclosure Protection Act, the Public Sector Integrity Commissioner is mandated to review and report on disclosures of wrongdoing by public servants. However, where the subject matter of any disclosure received is within the jurisdiction of the Office of the Conflict of Interest and Ethics Commissioner (Office), the Public Sector Integrity Commissioner must, under subsection 24(2.1) of the Public Servants Disclosure Protection Act, refer the matter to this Office.
In this case, in a letter dated September 18, 2019, the Public Sector Integrity Commissioner referred to me, under subsection 24(2.1) of the Public Servants Disclosure Protection Act, a disclosure of an allegation of a conflict of interest made against the Honourable Carla Qualtrough, who at that time was Minister of Public Services and Procurement Canada. As a minister, Ms. Qualtrough was a reporting public office holder subject to the Act.
The allegation in the disclosure related to Ms. Qualtrough's appointment of Ms. Moreen Miller as Chairperson of the Board of Directors (Board) of Defence Construction Canada (Defence Construction), a Crown corporation, while Ms. Miller was also President and Chief Executive Officer of Fowler Construction, a private construction company that, according to the discloser, had strong ties to the Liberal Party of Canada. The discloser did not cite any provisions of the Act that were alleged to have been contravened.
