When someone has failed to comply with the Conflict of Interest Act or the Conflict of Interest Code for Members of the House of Commons, the Commissioner can:
- Impose administrative monetary penalties for missing reporting deadlines in the Act
- Issue compliance orders under the Act
- Conduct an investigation, and report on it publicly.
There are no penalties when the Commissioner finds in an investigation that someone contravened the Act or the Code. It is up to the Prime Minister to take any further action on contraventions of the Act. The Commissioner may recommend sanctions for a Member who contravened the Code, but it is up to the House of Commons to impose any sanctions.
